Terms and conditions
The following Terms and Conditions will form
the basis of the agreement between the Client and the Artist.
* The Artist, Marilyn Stephenson will create
for the Client a portrait based on material supplied by the Client.
The medium, size, timescale and full price will be agreed between
the Artist and the Client. The Artist will confirm the details
by post or email before any work starts on the portrait. A deposit
of 40% of the final cost will be required before any work starts
(see below for details)
* The Artist will send the Client a digital image
(the digital image is the property of the Artist) of the portrait
(i.e. scanned proof). This is for viewing by the Client, who can
ask for any minor changes to be made to the portrait. If no changes
are requested the Client will be required to approve the portrait
and to send the final payment. Upon receipt of the final payment
the Artist will post the portrait to the Client. If any changes
are requested by the Client, these will be made by the Artist.
The Artist will send another digital image of the altered portrait
for final approval by the Client. On approval the Client will
be required to send the final payment. Upon receipt of the final
payment the Artist will post the portrait to the Client (to the
address supplied by the Client)
* The Client will provide the Artist with photos,
digital images or scanned images either by email, post (see About
Us for postage details) or hand deliver. It is the responsibility
of the Client to ensure that they own the copyright to the material
or have the permission of the copyright holder to use the material
before it is sent to the Artist.
* The Artist has the right to refuse any photos,
digital images or scanned images that are not suitable to prepare
the portrait from. In the event of this happening the Artist will
request additional photos from the Client. If the Client cannot
provide suitable additional photos the Artist will provide a full
refund of any money paid by the Client.
* The Artist will handle all Client's material
with care and return to the Client all material once the portrait
has been completed.
* All artwork produced by the Artist is protected
by copyright and may not be reproduced for any commercial reason
without the written consent of the Artist. The Artist retains
the right to reproduce the artwork for promotional use.
* After final payment for the portrait, the Client
is the owner of the portrait. The Client may make copies of the
portrait for non-commercial use only. In all reproductions the
Artist's signature must be present. The Client may purchase the
full rights to the portrait from the Artist.
* The Artist has the right to add her signature
to the portrait. This will be applied in a permanent way in a
location and size appropriate to the portrait.
* The price includes all materials that the Artist
requires to produce the portrait.
* The Artist will fully endeavour to produce
a portrait that the Client is fully satisfied with. However, if
the Client is unsatisfied with the final portrait, the work may
or may not be redone at the discretion of the Artist. If the Client
returns the final work to the Artist (notifying the artist within
14 days of receipt), a full refund minus all postage and packing
charges will be sent if the portrait is not redone.
* The Artist is not responsible for changes to
the portrait due to humidity, moisture, climate, mould, stains,
warping, shrinking, infestation, or any other damage that may
occur in the possession of the Client.
* The portrait will be mailed first class insured
mail. Order forms and receipts will be included along with a Certificate
of Authenticity if requested by the Client.
* All payments will be made in Pounds UK by cheque
or Money Order. Cheques should be made payable to
